1. INTRODUCTION
These Terms & Conditions ("Terms") govern the use of the Apex Tech website and all purchases made
through the website.
By accessing or using the Apex Tech website, creating an account, placing an order, or purchasing a product
through the website, you acknowledge that you have read and understood these Terms.
These Terms apply to purchases made by consumers in the Republic of South Africa.
Nothing in these Terms is intended to remove, restrict or waive any consumer right that cannot lawfully be
excluded under South African law.
Where any provision of these Terms conflicts with a mandatory provision of applicable South African law,
the applicable law will prevail.
2. ABOUT APEX TECH
Apex Tech is an online retailer offering technology products and accessories, including but not limited to: Mobile-phone accessories;
PC accessories;
Computer peripherals;
Cables and charging products;
Gaming accessories;
Consumer electronics;
Technology accessories; and
Other products made available through the Apex Tech website.
1
Apex Tech may use third-party suppliers, distributors, manufacturers and courier services to fulfil customer
orders.
Apex Tech may therefore operate using a direct-fulfilment or drop shipping model and may not physically
hold every product displayed on the website.
The use of a third-party supplier or fulfilment partner does not remove or reduce any rights a consumer has
against Apex Tech under applicable law.
3. ACCEPTANCE OF ORDERS
When you place an order through the Apex Tech website, you are making an offer to purchase the selected
products.
An automated order confirmation acknowledges that Apex Tech has received your order. It does not
necessarily constitute final acceptance where further verification is required.
Apex Tech may need to verify: Payment;
Product availability;
Product pricing;
Delivery information;
Fraud or security concerns; and
Other information reasonably necessary to process the order.
Where Apex Tech cannot fulfil an order because the product is unavailable, discontinued, incorrectly listed,
or otherwise cannot reasonably be supplied, Apex Tech will notify the customer as soon as reasonably
possible and provide any refund required by applicable law.
Apex Tech will not intentionally accept payment for products that it knows it cannot supply.
4. PRODUCT INFORMATION
Apex Tech makes reasonable efforts to ensure that product descriptions, photographs, specifications, prices
and other information displayed on the website are accurate and current.
However: Product photographs may be for illustrative purposes;
Colours may appear differently depending on the customer's display;
Packaging may vary;
Manufacturers may make changes to products;
Product specifications may change;
2
•
•
Accessories shown in photographs may not always be included unless expressly stated; and
Supplier information may occasionally become outdated.
The product supplied must nevertheless comply with the rights and standards applicable to consumers
under South African law.
Customers should carefully review the product description and specifications before ordering.
5. PRICING
All prices displayed on the Apex Tech website will be stated in South African Rand (ZAR), unless expressly
stated otherwise.
Where applicable, prices will include VAT and other mandatory charges as required by law.
Delivery charges, where applicable, will be displayed to the customer before the order is finally submitted.
Apex Tech reserves the right to correct genuine pricing or listing errors.
If an obvious pricing error occurs and the order has not yet been fulfilled, Apex Tech may contact the
customer to confirm whether they wish to proceed at the correct price or cancel the order and receive any
refund legally due.
Apex Tech will not deliberately use misleading prices to induce customers to purchase products.
6. PAYMENT
Orders must be paid using the payment methods made available on the Apex Tech website.
An order will generally only be processed once payment has been successfully authorised or received.
Apex Tech does not intentionally store full card details where payment processing is handled by a third
party payment provider.
Customers must not attempt to use fraudulent payment methods, stolen payment information,
unauthorised accounts or other unlawful means of payment.
Apex Tech reserves the right to suspend or cancel transactions reasonably suspected of fraud or unlawful
activity, subject to applicable law.
3
7. SUPPLIER AND THIRD-PARTY FULFILMENT
Apex Tech may purchase or source ordered products from third-party suppliers for fulfilment.
This means that:
Apex Tech may not physically hold the product at its own premises;
The supplier may package and dispatch the product directly to the customer;
A supplier or third-party courier may appear on shipping documentation;
Delivery times may vary depending on supplier processing and the customer's location; and
Apex Tech may need to obtain information from its supplier or courier when investigating an order.
The customer remains an Apex Tech customer.
Apex Tech will take reasonable steps to manage supplier and fulfilment issues and will not use the
involvement of a supplier as a basis for unlawfully avoiding its obligations to the customer.
8. DELIVERY
Apex Tech currently uses third-party suppliers and/or courier services to fulfil and deliver orders.
The estimated delivery period is generally:
3–7 business days
However, delivery times may vary depending on: The customer's location;
Supplier processing times;
Courier capacity;
Public holidays;
Weather;
Remote-area delivery requirements;
Customs or border procedures where applicable;
Unexpected logistical delays; and
Circumstances outside Apex Tech's reasonable control.
The 3–7 business-day period is therefore an estimated delivery period, unless a specific delivery date or
period has expressly been agreed with the customer.
Apex Tech will provide available tracking information where applicable.
Customers are responsible for providing an accurate delivery address and contact information.
4
Where a customer provides an incorrect or incomplete address, additional delivery costs or delays may
occur.
Apex Tech will not intentionally delay delivery.
Nothing in this section limits any statutory rights the customer may have regarding delivery.
9. DELIVERY ACCEPTANCE AND RISK
Apex Tech will comply with applicable South African laws regarding the allocation of risk in relation to
delivered goods.
Customers should inspect products as soon as reasonably practical after delivery.
If a product arrives visibly damaged, the customer should photograph the packaging and product and
contact Apex Tech as soon as reasonably possible.
Failure to report damage immediately does not automatically remove a consumer's statutory rights.
10. RETURNS AND COOLING-OFF RIGHTS
Apex Tech respects all mandatory consumer cancellation, return, replacement and refund rights provided
by South African law.
For qualifying electronic transactions, the Electronic Communications and Transactions Act 25 of 2002
provides a consumer with a right to cancel certain transactions without reason or penalty within seven days
after receipt of goods, subject to the statutory exceptions. The direct cost of returning the goods may be
charged to the consumer where permitted by the Act.
Where a customer wishes to exercise a statutory cooling-off right, the customer must notify Apex Tech
using the contact details provided on the website.
Products should be returned in accordance with the applicable statutory requirements.
Nothing in this section removes any additional rights provided to the consumer under the Consumer
Protection Act or any other applicable law.
11. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
If a customer receives
:A defective product; A materially damaged product;
The wrong product;
A product materially different from its description; or
A product that otherwise does not comply with applicable consumer law,
the customer should contact Apex Tech as soon as reasonably possible.
Apex Tech will assess the issue and provide the remedy required under applicable law.
Depending on the circumstances, the remedy may include: Repair;
Replacement; or
Refund.
The customer's statutory rights are not limited by any manufacturer's warranty or supplier warranty.
12. MANUFACTURER AND SUPPLIER WARRANTIES
Where a product is supplied with a manufacturer's or supplier's warranty, Apex Tech will communicate the
relevant warranty information where reasonably available.
A manufacturer's warranty does not replace or remove any mandatory rights the customer has against
Apex Tech under South African law.
Warranty claims may require reasonable information such as Order number;
Proof of purchase;
Product details;
Photographs or videos demonstrating the issue; and
A description of the fault.
Apex Tech may need to liaise with the manufacturer, supplier or authorised repair centre when processing a
warranty matter.
13. CHANGE-OF-MIND RETURNS
Where a customer wishes to return a product simply because they have changed their mind, Apex Tech will
distinguish between: A statutory cancellation or cooling-off right; and
Any voluntary return policy offered by Apex Tech.
A voluntary return policy will not remove or reduce a customer's statutory rights.
6
Where the law permits Apex Tech to impose reasonable return costs, such costs may be payable by the
customer.
14. REFUNDS
Where a refund is legally or contractually required, Apex Tech will process the refund using the payment
method reasonably available and appropriate for the original transaction, subject to applicable payment
provider procedures.
Refund processing times may depend on Apex Tech's processing time;
The payment provider;
Banking institutions; and
The method originally used for payment.
Where South African law prescribes a particular refund period, that period will apply.
If a product has already been delivered and must be returned before a refund can be processed, Apex Tech
may require the product to be returned where permitted by law.
15. PRODUCT AVAILABILITY
Because Apex Tech may use third-party suppliers, product availability can change without notice.
If a product becomes unavailable after an order has been placed, Apex Tech may Notify the customer;
Offer an alternative where appropriate;
Offer an updated delivery arrangement where appropriate; or
Cancel the affected order and refund the customer where required.
Apex Tech will not substitute a product without the customer's agreement where such substitution would
materially change what the customer ordered, unless otherwise permitted by law.
16. PRE-ORDERS AND SPECIAL ORDERS
If Apex Tech offers a product as a pre-order, this will be clearly indicated on the product page.
The expected availability or delivery date of a pre-order is an estimate unless expressly stated otherwise.
Customers will be informed of significant changes affecting the expected fulfilment of a pre-order.
7
Any cancellation rights provided by South African law will continue to apply.
17. WEBSITE USE
Customers agree to use the Apex Tech website lawfully.

Apex Tech takes payment fraud seriously.
Where an order is reasonably suspected to involve fraud, Apex Tech may delay processing while conducting
reasonable verification.
Customers must not intentionally initiate a fraudulent chargeback after receiving goods or services for
which payment is legitimately due.
Nothing in this clause prevents a customer from exercising a genuine statutory right to dispute a
transaction.
Where a legitimate chargeback or payment dispute occurs, Apex Tech may provide relevant transaction,
delivery and communication records to the payment provider or financial institution as permitted by law.

African law.

losses that are not reasonably foreseeable or legally recoverable from Apex Tech.

statutory consumer rights.
Nothing in this clause limits a customer's rights relating to defective, unsafe, unsuitable or improperly
supplied goods where those rights are protected by applicable law.
